TeeHubDeals operates an online platform that empowers users to design and sell their own T-shirts and merchandise. We have clear contractual guidelines prohibiting users from designing or selling items that violate the intellectual property rights of third parties, including but not limited to copyright, trademark, and related rights. If you believe a user on the TeeHubDeals service has infringed upon your intellectual property rights, we encourage you to follow the procedure outlined below.

A. Reporting Intellectual Property Infringement

  1. Identification of Infringed Material:
    • Specify the copyrighted work or intellectual property that has been infringed, including any applicable registration numbers.
  2. Description of Infringing Content:
    • Detail how the material is infringing on your intellectual property rights.
    • Provide the location of the infringing material on the TeeHubDeals service with sufficient detail for verification.
  3. Your Contact Information:
    • Include your full name, mailing address, telephone number, and email address.
  4. Good Faith Statement:
    • Confirm that you believe the use of the copyrighted work is not authorized.
  5. Statement Under Penalty of Perjury:
    • Confirm the accuracy of the information provided and assert that you are the rights holder or authorized to act on their behalf.
  6. Signature:
    • Provide an electronic or physical signature.

B. Handling of Infringement Notifications

Upon receipt of a proper infringement notice, TeeHubDeals will:

  1. Remove or disable access to the allegedly infringing content.
  2. Notify the member responsible for the content removal.
  3. Terminate access for repeat offenders.

C. Procedure for Supplying a Counter-Notice to the Designated Agent

If a notified member believes the removed content is not infringing, they can submit a counter-notice containing the following:

  1. Identification of Removed Content:
    • Describe the removed material and its previous location on the TeeHubDeals service.
  2. Good Faith Statement:
    • Affirm that the removal was a mistake or misidentification.
  3. Your Contact Information:
    • Include your full name, mailing address, telephone number, and email address.
  4. Consent to Jurisdiction:
    • Agree to the jurisdiction of the Federal Court.
  5. Signature:
    • Provide an electronic or physical signature.

If a counter-notice is received, TeeHubDeals may replace or restore the content in 10 to 14 business days, unless the rights owner files a court order seeking further action.

Please be aware that knowingly misrepresenting content or activity as infringing may result in liability under Section 512(f) of the DMCA, including damages and attorney’s fees.
